The judgment appealed from dismissed the action after demurrers to the original complaint and amended complaint had been sustained,
plaintiff having waived the privilege of pleading over. The action is in quo warranto, brought in the name of the state by private corporations after the attorney general had refused
to act. The relators are six state banks operating in Milwaukee county and referred to as independent banks, in contradistinction
to the 'big three' which have a majority of the bank deposits in the county. The seventh relator is the Bank Executives Club,
a non-profit corporation consisting of the managing officers of the independent banks. The defendant Marshall & Ilsley
Bank is one of the 'big three'.
